This webpage provides SMS terms, privacy information, and help instructions for text-message communications provided by APHEALTH PBC, doing business as APHealth (“APHealth,” “we,” “us,” or “our”).
These terms apply to service-related text-message communications between APHealth and its members, participants, prospective members, and other individuals who voluntarily consent to communicate with APHealth by SMS.
SMS communication does not create a guarantee of services, eligibility, benefits, referrals, authorizations, appointments, or outcomes.
1. APHealth SMS Terms and Conditions
About the APHealth SMS Service
The APHealth SMS service allows authorized APHealth employees to communicate directly with members and program participants through one-to-one text-message conversations.
· Appointment scheduling, confirmation, or rescheduling
· Care management and care coordination
· Follow-up regarding services or previously discussed needs
· Resource and referral information
· Requests for non-sensitive documents or information
· Responses to member questions
· Other communications directly related to APHealth services
The APHealth SMS service is intended for individual, conversational communication. It is not intended for bulk messaging, mass marketing, advertising, lead generation, or automated promotional campaigns.
Consent to Receive Text Messages
You will receive APHealth text messages only after you voluntarily consent to receive them or otherwise initiate a text-message conversation with APHealth where applicable.
Consent may be obtained verbally during a telephone or in-person conversation, in writing, electronically, or through another documented opt-in process.
By opting in, you authorize APHEALTH PBC dba APHealth to send service-related text messages to the mobile telephone number you provide.
Your consent to receive text messages:
· Is not a condition of receiving APHealth services
· May be withdrawn at any time
· Applies to APHealth service-related communications
· Does not authorize unrelated advertising or promotional messages
APHealth may maintain records of your consent, including your telephone number, date and time of consent, method of consent, consent language presented, and the employee who obtained consent.
Message Frequency
Message frequency varies.
The number of messages you receive depends on your needs, the services being coordinated, conversations you initiate, and whether follow-up is necessary. Some individuals may receive only occasional messages, while individuals actively coordinating services may receive messages more frequently.
Message and Data Charges
APHealth does not charge you for participating in its SMS service.
Message and data rates may apply according to the terms of your mobile telephone plan. Your wireless carrier is responsible for any charges associated with text or data usage.
Wireless carriers are not responsible for delayed or undelivered messages.
Text Message Delivery
Text-message delivery is not guaranteed. Messages may be delayed, blocked, misdirected, or undelivered because of circumstances outside APHealth’s control, including wireless carrier or network issues, device settings, incorrect or reassigned telephone numbers, service interruptions, full message storage, spam filtering, or loss of cellular or internet connectivity.
APHealth is not responsible for losses caused solely by a wireless carrier’s or communications provider’s failure to deliver a message.
Protecting Sensitive Information
Standard SMS messaging may not be encrypted or completely secure.
If a text message contains health information or other protected information, APHealth will handle that information in accordance with applicable privacy laws, contractual requirements, and APHealth policies.
Please do not send highly sensitive information by standard SMS, including:
· Social Security numbers
· Financial-account or payment-card information
· Government identification numbers
· Photographs of identification documents
· Detailed medical records
· Detailed mental-health information
· Detailed substance-use treatment information
· Detailed diagnostic or treatment information
· Other highly sensitive personal information
APHealth employees may limit information communicated by SMS and may ask you to continue a sensitive conversation by telephone, secure electronic communication, video meeting, in-person meeting, or another approved communication method.
By choosing to communicate through SMS, you acknowledge that text messages may be visible to anyone with access to your mobile device, telephone account, lock-screen notifications, or shared telephone number.
No Emergency Services
The APHealth SMS service is not an emergency service and is not monitored continuously.
Do not use SMS to report a medical, mental-health, safety, housing, or other emergency.
Call 911 or go to the nearest emergency department when immediate assistance is needed.
Text messaging should not be used when a delay in receiving a response could create a risk to your health, safety, or well-being.
Response Times
APHealth employees generally respond during their normal working hours. Response times vary based on employee availability, weekends, holidays, schedules, and the nature of the request.
A text message does not guarantee an immediate response, appointment, referral, authorization, benefit, service, or outcome.
Opting Out
You may stop receiving text messages from an APHealth telephone number at any time by replying:
Recognized opt-out words may also include:
QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE
After opting out, you may receive one final confirmation message. No additional SMS messages will be sent from that number unless you subsequently provide new consent or reply with an applicable opt-in keyword such as START.
APHealth will not intentionally use another telephone number to circumvent an individual’s opt-out request.
Opting out of SMS does not affect your eligibility for APHealth services. APHealth may communicate with you through another agreed-upon communication method.

Changing Your Telephone Number
Please notify APHealth if your telephone number changes, your phone is lost or stolen, your number is disconnected or reassigned, or you no longer control the device receiving APHealth messages.
Consent associated with one telephone number does not automatically transfer to a different or reassigned number.
Changes to These Terms
APHealth may update these SMS Terms when its services, technologies, operational practices, or legal obligations change.
The revised version will be posted on this webpage with an updated revision date.
2. APHealth SMS Privacy Statement
Scope of This Privacy Statement
This Privacy Statement applies to information collected, used, maintained, or disclosed through the APHealth SMS service.
It explains APHealth’s practices specifically relating to text-message communications. Other privacy notices, consent forms, health-information notices, or service-specific privacy requirements may separately apply to services provided by APHealth.
Information We May Collect
Through the APHealth SMS service, we may collect and maintain:
· Your mobile telephone number
· Your SMS consent or opt-in record
· The date and method of consent
· Copies or records of messages sent and received
· Dates and times of communications
· Opt-out and support-request information
· The identity of the APHealth employee involved in the conversation
· Information you voluntarily provide by text
· Information reasonably necessary to coordinate or document APHealth services
Text-message communications may become part of your APHealth service or care-management record when appropriate.
How We Use SMS Information
APHealth may use SMS information to:
· Send and receive service-related communications
· Schedule and coordinate appointments
· Provide care-management or care-coordination support
· Follow up regarding referrals, resources, services, or member needs
· Confirm or update contact information
· Document communications
· Maintain evidence of consent and opt-out requests
· Operate, secure, maintain, and improve the SMS service
· Meet legal, regulatory, contractual, quality-assurance, compliance, or recordkeeping obligations
· Protect the safety, rights, property, and operations of members, employees, and APHealth
APHealth limits the use of SMS information to legitimate service, operational, legal, compliance, security, and administrative purposes.
Mobile Opt-In Information
Mobile telephone numbers, SMS opt-in information, and SMS consent records will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes.
Text-message originator opt-in data and consent will not be shared with third parties for their own marketing, advertising, or promotional purposes.
APHealth will not use consent obtained for service-related SMS communications to enroll individuals in unrelated marketing programs.
Service Providers and Message Delivery
APHealth may use telecommunications providers, communications platforms, wireless carriers, technology vendors, hosting providers, security providers, and other service providers necessary to transmit, receive, maintain, secure, register, administer, or support SMS communications.
These providers may process information only as reasonably necessary to provide or support these services.
APHealth does not authorize service providers to use mobile opt-in information or SMS consent for their own marketing or promotional purposes.
Required or Permitted Disclosures
APHealth may disclose information when reasonably necessary to:
· Comply with applicable law, regulation, subpoena, court order, or governmental request
· Meet contractual obligations associated with APHealth services
· Protect the safety or rights of an individual
· Investigate fraud, misuse, security incidents, or unlawful activity
· Protect APHealth’s systems, personnel, rights, or property
· Respond to emergencies where disclosure is permitted or required
· Work with authorized service providers supporting APHealth operations
When health information is involved, APHealth will handle that information in accordance with applicable privacy laws, contractual requirements, and organizational policies.
Security
APHealth uses reasonable administrative, technical, and physical safeguards designed to protect information under its control.
However, no SMS, mobile, wireless, or electronic communication system can be guaranteed to be completely private or secure.
SMS messages may be stored on your device or in backups, displayed on a lock screen, viewed through a shared account, retained by communications providers, sent to an incorrect or reassigned number, or disclosed through circumstances outside APHealth’s control.
For these reasons, APHealth discourages sending highly sensitive information through standard SMS.
Record Retention
APHealth may retain SMS records for the period reasonably necessary to:
· Provide and document services
· Maintain member or service records
· Resolve questions or disputes
· Demonstrate consent or compliance
· Complete audits or quality reviews
· Meet contractual, insurance, legal, regulatory, or recordkeeping obligations
Records will be disposed of in accordance with applicable APHealth record-retention and information-security practices.
Your Choices
· Decline SMS communication
· Revoke SMS consent by replying STOP
· Request another reasonable communication method
· Ask APHealth to update or correct your telephone number
· Ask questions about how your SMS information is handled
· Notify APHealth that a telephone number should no longer be used
Declining or discontinuing SMS does not prevent you from receiving APHealth services through another available communication method.
